Is waterboarding a war crime?

It seems Ted Kennedy made a speech in Congress somewhere around September 28, 2006 about Yukio Asano being charged with war crimes for water torture.

Check this post cached on Tailrank called I Was Duped by Kennedy.

It seems that Yukio Asano was charged for multiple war crimes. Among them were burning people with cigarettes, kicking, punching, clubbing and otherwise hitting prisoners of war.

I guess Mr. Kennedy forgot to mention that part.
